In 2016, Newcastle chef Ben Batterham found a burglar, armed and high on drugs, lurking in his baby’s bedroom. He saw red, and pursued the intruder out of his house and down the street. There was a violent struggle as Ben attempted a citizen’s arrest. Moments later the burglar suffered a heart attack and died. Ben Batterham found himself arrested and charged with murder. And in 2019, a jury found Ben not guilty of the 2016 murder and manslaughter of home intruder Richard Slater. Now, Ben Batterham is set to get a payout from the New South Wales Government for wrongful prosecution by police. Working out who abducted and then murdered three-year-old Cheryl Grimmer from a crowded Wollongong beach almost 50 years ago should be easy. Eighteen months after the sickening crime a man claiming to be the killer admitted it. He gave detectives a detailed confession. But surprisingly, that admission didn’t mean it was “case closed”. As Tara Brown reports, cursory police work and an extraordinary legal technicality has meant the confessed murderer has never been prosecuted for the crime, and remains free.
